What is Whiplash?

In our experience whiplash claims are the main personal injury compensation claim from road traffic accidents. We all know the reason for wearing a seat belt but this doesn't help protect the head and neck, resulting in a whiplash injury.

Areas which can be affected:

  • Whiplash in neck
  • Whiplash in back
  • Whiplash in shoulders

The impact from another vehicle causes a sudden movement in the head and neck causing whiplash neck, whiplash back, whiplash shoulder injuries or can even occur in all three. It is said that at least 1 in 5 rear end car accidents result in these types of injury and entitles you to make a claim for whiplash injury when involved.

Speed of impact, although this can be a factor in whiplash injuries, a 2006 survey suggested that the head-rest distance can reduce or increase the severity of the whiplash injury.

Another cause of whiplash is strong blows to the head.

Recovery time for Whiplash Injury

Depending on the severity of the whiplash injury is dependant on the recovery time. Some people recover quite quickly where as others have long lasting effects for e.g. feeling aches and pain on cold mornings. If your injuries you to have time off work, we can help recover any loss of earnings as part of the No Win No Fee claim for whiplash injury.

It is recommended that you visit the doctor who can easily diagnose if you have a whiplash injury. It is also an important part of the claims process that you have medical attention and your medical records have recorded that it was due to the car accident you were in. These records will determine how much compensation we can get for you.

Symptoms of Whiplash

  • Headaches
  • Pain in the neck, shoulders and arms
  • Dizziness

In severe cases:

  • Memory Loss
  • Problems concentrating
  • Tinnitus (ringing in the ears)
  • Depression

Independant Legal Advice

For whiplash injury claims it is important you get independant legal advice when making a personal injury claim for whiplash injury. Some insurance companies will try and contact claimants and offer an amount for whiplash injury claims. These amounts are normally lower, so dont forget to insist on getting independant legal advice before accepting any early compensation settlement.

Your Options:

Important note: Once the liability for the accident has been established, the "at fault" driver's insurance will pay for the damages to the cars. This will normally result in their insurance premium being increased and a loss of no claims bonus. Once this has happened then it doesn't matter how many Personal Injury or whiplash claims are made, no further penalties are made to the policy, so if you are a passenger in an "at fault" car smash then your conscience is clear.
